Terms of Service

Welcome to SchoolSwipe. Read these terms before you use our software and services. If you have questions, contact support@myeventswipe.com.

These terms apply to schools, districts, and related entities that sign up for the Services. These terms also apply to all other users, including students, teachers, staff, and parents. All of these parties are called "Users" or "you". If you are a School, the Additional Terms for Schools are incorporated into and form part of these Terms by reference.

If you use the Services, you agree to these terms and to our Privacy Policy. If you do not agree, you may not use the Services. Our Services change often. Our terms might change. If you are a School, we will notify you before any material change. We will update the effective date when changes take effect. Your continued use after a change means you accept the updated terms. Notices and other communications may be provided electronically, including by email to the address associated with your account, and such notice will be deemed legally sufficient. You are responsible for keeping your contact information current.

SECTION 1. WHAT ARE SCHOOLSWIPE SERVICES AND WHO CAN USE THEM

SchoolSwipe provides Schools with a configurable software platform and related services designed to support a wide range of educational, administrative, operational, and engagement-related use cases. The Services may include, but are not limited to, tools for data collection, participation tracking, communications, workflows, transactions, integrations, analytics, and other functionality that Schools may enable from time to time. These tools are intended to help Schools operate more efficiently, engage their communities, and support evolving educational and organizational needs.

You may use the Services only if you form a binding contract with SchoolSwipe and follow all applicable laws and the Privacy Policy. If you were removed from the Services before, you may not use them again.

STUDENT USE, MINORS, AND COPPA

The Services are intended for use in K–12 educational environments only and may be used by students who are minors who have been authorized by the School and their parents or guardian.

When Schools authorize student access to the Services, the School represents and warrants that it has provided any required notices and obtained all legally required parental or guardian consents, including consent required under the Children's Online Privacy Protection Act ("COPPA"). Schools act as the authorized agent of parents or guardians for purposes of providing consent for the collection and use of student information solely for School-authorized educational purposes.

SchoolSwipe does not knowingly collect personal information from students outside of School-authorized use of the Services, and we collect and use student information only to the extent reasonably necessary to provide the Services.

Parental rights to review, delete, or restrict a child's personal information are handled through the School as the parent's point of contact; Schools may submit requests to SchoolSwipe at support@myeventswipe.com.

Additional details about children's data practices, including categories of information collected, use, sharing, and retention, are described in the Privacy Policy and (for Schools) the Additional Terms for Schools. The terms of the Privacy Policy and the Additional Terms for Schools are incorporated herein and made a part of the General Terms of Use as though more fully set forth in this document.

ACCOUNT DETAILS

Your SchoolSwipe account provides access to the features we offer. Only an authorized representative may create a School account. If you create an account on behalf of a School, you confirm you have the authority to bind the School to these terms.

You are responsible for your account. Use a strong password. Do not use another user's account. If your account is compromised, notify us as soon as possible. We are not responsible for any loss you incur caused by unauthorized activity on your account.

Subject to your compliance with these terms, SchoolSwipe grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for authorized School-related purposes, including educational, administrative, operational, and community-related uses approved by the School. No other rights are granted.

ACCOUNT CONTROL

You control your profile and account settings. If you share your email address with us, you agree to receive service notices and required legal or other updates. You adjust preferences in your account settings. If you turn off marketing messages, you might stop receiving optional notices about new features.

RESTRICTED USES

Do not harm or interfere with the Services. You agree to avoid the following actions.

• Copying or distributing service content.
• Using automated systems that send abnormal levels of requests.
• Sending spam or unsolicited email.
• Interfering with service security or trying to decipher transmissions.
• Placing high load on our systems.
• Uploading malware or harmful software.
• Collecting personal information from the Services.
• Using the Services for unrelated commercial solicitation.
• Impersonating others or hiding your identity.
• Interfering with service operations.
• Accessing content through unauthorized systems.
• Bypassing security restrictions.

SERVICE CHANGES

SchoolSwipe might change, pause, or stop features at any time. We try to provide notice when possible. If the General Terms of Use end or are discontinued, you remain bound by them in any continued interaction with the Services.

You are responsible for your interactions with other users. SchoolSwipe is not responsible for issues between users.

SUSPENSION AND TERMINATION

SchoolSwipe may suspend or terminate your access to the Services, in whole or in part, at any time if we reasonably believe you have violated these terms, pose a security or legal risk, or if required to comply with law. Upon termination, your right to use the Services immediately ends. Sections relating to intellectual property, indemnification, limitation of liability, dispute resolution, and governing law will survive termination.

SECTION 2. RIGHTS IN OUR CONTENT

Student Data means information directly related to an identifiable student maintained by a School. This includes information covered by FERPA. The School owns Student Data. We handle Student Data only as needed to support the Services. Our Privacy Policy and Additional Terms for Schools explain these duties. We do not share Student, Staff, or School data with third parties outside the app hosting provider that stores service data for SchoolSwipe.

Except as required to provide the Services, SchoolSwipe does not sell or share Student Data with third parties or as otherwise provided in the Privacy Policy.

Intellectual Property Rights include all protected content such as software, text, images, graphics, logos, and related materials. All content in the Services, other than Student Data, belongs to SchoolSwipe or its licensors. You may not copy or distribute our content without written permission.

If you submit ideas or feedback, you grant SchoolSwipe the unrestricted right to use them in any way without financial or other obligation on the part of SchoolSwipe.

SECTION 3. GENERAL LEGAL TERMS

SCHOOLSWIPE DATA

Certain features of the Services provide reports, analytics, or other information associated with your account ("Service Data"). Subject to these Terms, SchoolSwipe grants you a limited, non-exclusive license to access and use Service Data solely in connection with your authorized use of the Services.

SchoolSwipe owns and retains all right, title, and interest in and to the Services, the underlying systems and infrastructure, and all data stored on SchoolSwipe's servers, except for Student Data. Student Data remains the property of the applicable school or district, as defined elsewhere in these Terms.

Reports, analytics, and other outputs generated by the Services are provided for informational purposes only. Schools remain solely responsible for all decisions, actions, and compliance obligations arising from their use of the Services and any outputs generated through them.

SchoolSwipe will implement reasonable administrative, technical, and physical safeguards designed to protect Student Data in accordance with applicable laws and generally accepted industry standards. However, SchoolSwipe does not guarantee the preservation or availability of any data. Data stored on SchoolSwipe's servers may be deleted in accordance with SchoolSwipe's data retention practices or upon termination of the Services.

SchoolSwipe is not a system of record and is not responsible for data loss. Schools are solely responsible for maintaining secure, accurate, and authoritative copies of Student Data and should not rely on the Services as their primary or exclusive data repository.

PRIVACY AND SECURITY

We take user privacy seriously. By using the Services, you agree to data practices described in the Privacy Policy and, if you are a School, the Additional Terms for Schools. You acknowledge that data is processed in the United States.

PAYMENTS AND POINT OF SALE SERVICES

If you use Point of Sale or payment-related features, you acknowledge that SchoolSwipe is not a bank or financial institution. Payment processing may be provided by third-party processors. SchoolSwipe is not responsible for chargebacks, payment disputes, transaction reversals, or errors caused by third-party processors. Schools are solely responsible for ensuring compliance with applicable financial, tax, and accounting requirements.

THIRD PARTY SERVICES

The Services might link to external websites or tools. SchoolSwipe is not responsible for external sites. If you use those sites, you do so at your own risk. Their own terms and privacy policies apply.

INDEMNITY

You agree to indemnify and hold harmless SchoolSwipe and its employees, contractors, agents, officers, and directors from claims, losses, or expenses arising from your use of the Services, your violation of these terms, your violation of rights held by others, your violation of law, content submitted through your account, or unauthorized use of your login credentials, to the extent permitted by applicable law.

WARRANTY DISCLAIMER

The Services are provided on an as is and as available basis. Use the Services at your own risk. SchoolSwipe provides no warranties, including fitness for purpose or error free operation. We do not guarantee accuracy of content, uninterrupted service, correction of defects, or freedom from harmful components.

LIMITATION OF LIABILITY

SchoolSwipe is not responsible for indirect or consequential losses including loss of profits, data, goodwill, or use. SchoolSwipe is not responsible for damage caused by unauthorized access, bugs, viruses, system failures, or user postings. Total liability will not exceed the amount paid for SchoolSwipe in the twelve (12) months preceding the claim or one hundred dollars ($100), whichever is greater.

GOVERNING LAW

These terms follow the laws of the State of Illinois. Any disputes fall under the jurisdiction of state or federal courts in Lake County, Illinois. Any dispute arising out of or relating to these terms or the Services will be resolved exclusively in the state or federal courts located in Lake County, Illinois. You and SchoolSwipe waive any right to a jury trial to the extent permitted by law.

CLASS ACTION WAIVER

To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. This section does not apply to Schools to the extent prohibited by applicable law.

FORCE MAJEURE

SchoolSwipe will not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including acts of God, natural disasters, labor disputes, internet or utility failures, governmental actions, or failures of third-party service providers.

MISCELLANEOUS

You may not assign these terms without our consent. SchoolSwipe may assign these terms, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets, without your consent. These terms constitute the entire agreement between you and SchoolSwipe regarding the Services. If any provision is unenforceable, the remainder remains in effect. Failure to enforce any term is not a waiver.
